What happens to my wage garnishment when I file for bankruptcy?

If you fall behind on debt payments, eventually the creditor will probably try to garnish your wages or bank account. A garnishment is a court order that requires an employer or a bank to turn over money that they are holding to the creditor. First the creditor must get a judgment against you for the money due. A bankruptcy stops this process cold at any point along the way. If you are already being garnished, you may be able to recover any money taken from your pay check in the last 60 days.
